Definitions

• Service: The Barcardz website, mobile applications, and related online features (e.g., customer support, social and trading functions).
• User Content: Any text, images, or other content submitted by users.
• Limited Edition: Cards that are globally capped in quantity and available by chance only.
• Token: In-game currency used to unlock cards or access features.
• Digital Goods: Non-tangible items delivered in the Service, including cards, tokens, and other in-game items.
• Account: A registered user profile, including parent and child accounts.
• Intellectual Property (IP): All copyrights, trademarks, trade secrets, and other proprietary rights in any content or materials.

1. Introduction

Welcome to Barcardz, operated by Bobos Studios LLC (“we,” “us,” or “our”), a company incorporated in the United Arab Emirates. By accessing or using our Service, you agree to these Terms & Conditions (“Terms”). If you’re under 13, your parent or legal guardian must read and accept these Terms on your behalf.

2. Modifications to the Terms

We may modify these Terms at any time; material changes will be posted on this page with at least 30 days’ notice. Your continued use of the Service after those changes become effective constitutes your acceptance of the new Terms.

3. Account Eligibility & Parental Consent

• Adults (13+): Register with email, display name, and password.
• Children (< 13): Parents register with email and password, verify via a code sent by email or SMS, then create and manage child accounts. Child accounts log in via a parent-defined username and password (no child email). Parents may pause/reactivate child accounts, manage billing, and are responsible for any violations of these Terms and any financial obligations incurred by their child.

4. Game Mechanics & Coins

• Free Coins: Each new collection grants 100 free coins.
• Unlock a Card: Costs 20 tokens; yields a random Standard (~90%), Rare (~9%), or Limited Edition (~0.1%) card. Limited Editions are globally capped—once exhausted, they cannot be unlocked.
• Progression: Complete a card’s progress bar by scanning barcodes (via ZXing). Once full, you earn 1 token.
• Abuse Prevention: Barcode values reset every 24 hours; each barcode can be used only once per player per day.
• Ads for Tokens: Watch 3 approved video ads to earn 30 tokens.
• Instant Unlocks: Spend 100 tokens for a specific Standard or 300 tokens for a specific Rare card. Limited Editions remain luck-based only.

5. Purchases & Payments

All in-game purchases (token bundles, instant unlocks) are processed via Stripe. By completing a purchase, you agree that Digital Goods are delivered immediately and are non-refundable, except as required by applicable consumer protection laws. For possible refunds under such laws, contact support@playbobos.com. All prices exclude applicable taxes, which are your responsibility.

6. Friends, Trading & Brands

• Friends & Trading: You may add friends and propose mutual trades of cards. Trades must be accepted by both parties to complete.
• Following Brands: You can follow select brands on Barcardz to see their public collection updates. Brands do not receive your personal data—only your public username and unlocked-card metadata.

7. Third-Party Brand Collections

We partner with third-party brands who design and publish their own card collections on Barcardz. Although these collections are developed independently, we review every branded set before it goes live to ensure it’s fully age-appropriate. We reserve the right to remove any collection that fails to meet our standards.

8. Original Collections & Non-Infringement

All internal collections created by Bobos Studios LLC are developed independently without reference to existing IP. Any resemblance to characters, brands, or other works is purely coincidental. We retain all rights to our original collections and ensure they do not infringe on third-party IP.

9. Intellectual Property & User Content License

• Our IP: All game assets, code, collections, names, and logos are owned by Bobos Studios LLC or its licensors.
• Your Content: By submitting any User Content, you grant us a worldwide, irrevocable, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, modify, and distribute that content in connection with the Service and our marketing materials.

10. User Conduct

You agree not to:

• Cheat, reverse-engineer, or manipulate gameplay.
• Harass other users or post inappropriate content.
• Circumvent security measures.

Violation of these rules may result in suspension or termination of your account and forfeiture of any in-game assets or balances associated with the account.

11. Availability, Disclaimers & Limitation of Liability

Availability: We strive to keep Barcardz available 24/7, but the Service may be inaccessible for maintenance, downtime, or causes beyond our control.

Disclaimers: Barcardz is provided “as is” and “as available,” without warranties of any kind.

Exclusion of Damages: To the fullest extent permitted by law, we disclaim liability for loss of data, profits, goodwill, interruption of business, or other intangible losses.

Monetary Cap: Our aggregate liability shall not exceed the greater of your spend on the Service in the prior 12 months or USD 100.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bobos Studios LLC and its officers, directors, employees, and agents from any and all third-party claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your breach of these Terms;
• Your use of the Service;
• Any User Content you submit;
• Your violation of any law or rights of another;

You agree to cooperate in any defense, and we may assume exclusive control of the defense and settlement, provided we notify you in writing.

13. Dispute Resolution

Before filing any legal claim, you agree to attempt informal resolution by contacting us at hello@playbobos.com for at least 60 days. Any unresolved disputes shall be resolved exclusively in the courts of the UAE.

14. Feedback License

Any feedback, comments, or suggestions you provide regarding the Service are non-confidential and you grant us a perpetual, irrevocable license to use them without obligation.

15. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us, constitute the entire agreement.

16. Severability

If any provision is held invalid, the remainder shall remain in effect.

17. Assignment

You may not assign your rights; we may assign ours without notice.

18. Force Majeure

We are not liable for failures due to causes beyond our control.

19. Third-Party Links & Content

Our Service may contain links to third-party content; we do not endorse or assume responsibility for it.
